I'm all for tougher regulations on drunk driving, but if the limit is 0.08, then leave people alone who blow under. If you want to harp on people with a BAC of 0.06 then make the limit 0.0599.
I personally think you should not be permitted to drink at all before driving. Most people will admit after one standard drink, they do not feel as sharp as they do completely sober. |

I'm not a heavy drinker by any means, but the last time I can remember feeling tipsy after one drink must have been around age 17. I think fatigue is more likely to be a problem for many people.
Unless by "standard drink" you meant a bottle of wine. |

I don't mean tipsy, I mean not as clear headed. Other factors that affect the speed of alchol absorption affect this greatly, like how much you've had to eat, whether you've just exercised, and how tired you are. So one drink can be fine for someone one day, but not on another. I think the 0.08 guideline is a bit ridiculous, as people have no way of knowing what their BAC is before they get behind the wheel. |

Well that's just it. What's fine for some is not fine for others, and because SOME people can't handle a single standard drink before getting behind the wheel, those who can are gonna get dinged, and they aren't even breaking the law.
It's also silly to have a law, as you stated, that we have absolutely no power to verify whether or not we are breaking until we're caught.
I could understand if the laws are tightened up. In this case, however, the law hasn't been changed, they've just given police more power to punish people who aren't breaking the law to begin with, however .05-.08 has ALWAYS landed in the discressionary (sp) zone. 12 hour suspensions and the like...
Change the law, or leave it alone. It's too bad the average sheep of a person will just shake their fist while stating "Well, you shouldn't be driving drunk anyway!" As if a beer or two constitutes being 'drunk'. Bah. |

| I dunno, the suspension for blowing over the legal limit in Germany (and most European countries) is 1 year. 0.05 is the limit. |

Very true. I agree that the limit should the the limit. Leave the arbitrary decisions about the sentencing out of the actual officer. |

One doesn't have to blow 0.08 for the alcohol in the blood to interfere with driving a vehicle.
I think this change in law recognizes that and provides a further deterrent for people. |
