Ontario is looking for $50-billion from a group of tobacco companies to recoup health care costs linked to illnesses stemming from tobacco use.

Under the Tobacco Damages and Health Care Costs Recovery Act, which passed the provincial legislature this year, Ontario can file suits against companies seeking the recovery of tobacco-related damages.

The legislation impacts alleged damages from the past and present, as well as ongoing tobacco-related health issues.

Although the new law allows government to move forward with the process, it is still required to prove its allegations in court.

Ontario is among six other provinces to have taken steps to recover health costs from tobacco companies.

British Columbia introduced in 2000 similar legislation, which was contested by Montreal-based Imperial Tobacco Canada Ltd. In 2005, the Supreme Court of Canada upheld the B.C. law, allowing the province to seek health costs from tobacco companies dating back 50 years.

New Brunswick, Nova Scotia, Newfoundland and Labrador and Manitoba have also enacted tobacco-cost recovery laws.

In May, a similar bill was tabled in Quebec, where a health department study estimated the health care costs of smoking in the province at $4-billion a year.

1) If they win then i guess there should be no more taxes on smokes to "offset the health costs".

2) If they win im guessing they will go after mcdonalds for heart attacks and liquor for cirrhosis of the liver and drunk driving. And who knows what else?

3) it's unbelievable that a government can sue a legal business for selling a legal product that the government themselves profit on in a huge way.

4) If they are going to use public health care as a crutch to try and put legal companies out of business and micro manage our lives, please opt me out!

5) Tobacco should give the government a taste of their own medicine and sue them for allowing and profiting off of gambling and lotteries. Im just saying.... whats good for the goose.

More sensationalist bull. This has been done in numerous provinces as part of a nation-wide strategy against tobacco and lung cancer... it has very little do with the Liberals, McGuinty or their platform.

Go troll people on a newspaper website or something ffs.

I can see this spiralling out of control if the province actually wins. This will set a dangerous precedent. What will stop the government from suing any and every business that causes someone to need medical assistance. The government will start suing all the minor sports associations for sport related injuries.

But the province hasn't taken any legal action against anyone. They've simply passed a law.

can't believe i'm agreeing with you, jay! :tongue2

on the same token, why isn't the gov suing alcohol companies for alcohol abuse and related health problems. oh wait... lcbo.

they should just ban tobacco and alcohol... yey prohibition!

This kind of legislation is a slippery slope yes, but I can see where they are coming from... Lung Cancer is one of the leading causes of death in Ontario.

geez they should just scrap public healthcare and let the cancer patients die slow painful deaths.

/neo-con solution.

They still have to prove their allegations in a court of law.

The government could basically pass laws that would allow them to recoup any healthcare money where cause can be directly linked to a business.

Better yet... quit using public health care as a crutch to control society.

Either we fund EVERYONE'S lifestyles as is universally, or we dont. None of this picking and choosing who should do what based on cost.

Lets see the government sue the ski industry for health care costs associated with ski injuries. You get my point?

We already have partial tobacco prohibition and the natives and gangsters are profiting quite nicely.

That's what it will lead to....the government passes some new Act and then recover health costs.....basically all but essential services could be recouped. Hell, they will probably pass a You Got Your Women Preggers Damages and Health Care Costs Recovery Act.
