i would think he has the responsibility to know the laws of the states he is dealing with since he is dealing with controversial material.

what about drugs like salvia that are legal in some states and illegal in others? if a person sells into one of those states where it's banned, i would think they are in trouble just like the person who buys. would this be seen as comitting a crime across state lines and then be considered federal jurisdiction?

While that possibly could hold ground, a charge like obscenity is very very very generic and vague. Numerous cases have gone to the Supreme Court and the result has always fallen on the side of free speech.
