if u r listening to an mp3 at home, u would of had to pay for that.. so its a crime which u downloaded it. makes no diff if u play it out in a club or not to the artist u ripped off.

When you have an mp3 on your computer you are not getting paid. When you play illegal mp3s on a club you are paid. do you see the difference? its not the fact that you got the song its the fact that you are getting paid for something you havent paid yourself.

Hmm... I always thought that owning the record or CD doesn't automatically give you license to play it in public (just read the label). The club is supposed to pay for the license. (This could depend on what country you're in, though. I'm not sure.) So in theory, the artists/publishers should get paid regardless. And more importantly, you as the DJ do not pay for your right to play.

What about playing white labels with uncleared samples?

What about playing your OWN tracks containing samples taken from illegally downloaded songs?

Another thing is that you're not just paying a DJ for his/her music collection. You're paying for mixing skillz and programming abilities. Someone who spins all illegal copies might still throw the best party ever. So a good DJ definitely adds value to the music he/she spins. So maybe such a DJ shouldn't be paid as much if all the music hasn't been paid for.

I can't tell from the article itself, but many of you suggested that the Italian DJ was doing quite well for himself. And if that's true then I must say that he should have supported the musicians and producers made the music that made him rich. I'm sure that would have come out to less than 1.4 million Euros...

I just think it's hilarious how this thread went from "Wow, that's a lot of money" type comments to "He should have been fined more" and "serves him right" when we found out it was Gabry Ponte.

Incidentally, where is that information from? Can it be verified?

there is such a thing as presumtion of innocence, i.e. the prosecution has to prove that he downloaded it illegally, not the defendant proving that he didn't illegaly download it.

well I think it's fair enough. Had he been playing all or most off vinyl and the occasional tune on CD-R then there would have been no reason to take it this far. For s sake, he was obviously downloading ALL his tunes from hubs. Food for thought I guess.:)
