well I've woken up to being touched & my legs being opened, my b/f knows I am a light sleeper so anything would wake me up, I don't think he had/has a rape fantasy because looking at it like that is kinda creepy.

I think thats just good times. Its actually really cool to wake up and realize the other person is into it.

She said she was passed out (from intoxication).
FYI, in most north american jurisdictions any sex act without prior expressed consent is rape, therefore, even if he expected her to wake up chances are that it would be considered rape under law. |

I think one of the key things to look at here is motivation. Did he actually want her to wake up? IF so then that mitigates it a bit but if he would have prefered she stayed sleeping then I think this whole thing is a sign of very servious and potentially dangerous personality defects. |
i really wouldn't go so far as to call it "rape" though... i mean there's a pretty huge difference between "rape" and being forward and/or kinky with someone you're in a serious relationship with. i would never consider that rape if it happened to me... if i didn't want it, i'd push him off, roll back over and start snoring. if it's something that he keeps attempting, i'd tell him to chill out and quit it.
then again i tend to have pretty leniant attitudes towards sex, so maybe i'm the pervert. |

ok since she was passed out... its pretty ed up. Now about the rape thing, I mean come on if you dont mean any harm to the other person and its your gf or wife then its just not rape. Obviously if you know your partner would not be into this kind of thing then DONT DO IT. if you know she'd like it then go for it. |

OOOO ok...I was really intoxicated once to the point I was completely blacked out. My b/f said he wanted to have sex but he felt so bad that I was passed out to the point I would have never known if he had sex with me & that didn't make him feel comfortable. I can see why. |
