Are you sure this guy's gonna sue me? And if so, you're saying that the insurance company has to pay for everything? Will they still do that since the car was LENT to the guy who was driving it (family friend) at the time of accident? Also, as a result of this (first accident EVER), will our insurance go up wayy high, like a few hundred %?

speed is irrelevant on this type of charge...in fact, it's assumed that you were going slow. I think this used to be called "turn not in safety" (at least it was 14 years ago when I was charged with it, lol)

if you were speeding around the corner, or driving in an otherwise unsafe manner, you could have been charged with a more serious offense like dangerous driving ;)

so what's the deal with witnesses...I mentioned this earlier in the thread. All of this insurance, lawsuit and charges could potentially go away if you had witnesses who would substantiate your story that this motorcycle illegally passed a bunch of stopped cars before hitting you.

It doesn't matter who is driving the vehicle as long as there was permission given or implied for the person to drive the vehicle. Your insurance company will upto the liability limit under the policy...if the claim goes over that then the insured would be on the hook.

and yes, it doesnt matter who the driver of the car was. The insurance for the person who insured that vehicle will (likely) go up. Not only because of the accident, but the ticket as well.
