Getting Paid

Question.

So lets say you are getting paid every 2 weeks.

The way it works is you work week 1, work week 2, at the end of week 3 you get your check for the first two weeks.

Now, can an employer do this?

work week 1, work week 2, work week 3, paid at the end of week 4 for week 1 and 2.

Don't you have to get paid immediately the following week? Are they allowed to withhold 1 week of your pay untill you quit?

Can you please explain?

Cuz I was looking at the Employment Standards Act and it says that the employer cannot withhold any pay unless agreed upon with the employee..
Abercrombie
That's the norm, better get used to it.
Pett

Can anyone quote from the Employment Standards Act where it says they can withhold pay??
Cro_Addict
Oh and also question about Holiday Pay...

Just cuz you are still on your 3 months probation you still have to be paid your holiday pay right???

it is mentioned to you on paper, or verbally when you sign on with a company (tridtionally anyway) so you have agreed to it - you just don't know that you have :p

second, last time I checked the employer can wait up to at least a week to pay you for a pay period (a week after the pay period) so it is perfectly legal.

Pett
it gives everyone time to get your money, you can't expect to work friday and get paid for friday immediately. Its in your best interest so you get all your overtime paid properly. you'll also appreciate it when your ass gets fired and you have an extra week of pay while you look for a new job

"An employer shall establish a recurring pay period and a recurring pay day and shall pay all wages earned during each pay period, other than accruing vacation pay, no later than the pay day for that period. 2000, c. 41, s. 11 (1)."

So that means that they can't wait 1 week after...

Also..

No, I was not told. I remember very well what I signed because I have all the papers in front of me (I asked for copies)

Oh..i am not trying to argue, I just want to know if there is an acutal explanation other than just cuz....unless I agreed to it (which I did not)

Thanks for all the replys
