then how is a court meant to distinguish between similiar crimes of different natures or severity? you can't codify every last detail or you'd wind up with more technicalities than you would ever want.
at some stage in the process you have to allow the judges/magistrates, district attorneys and juries to do their job. i am more concerned with people getting punishments that fit the crime rather than a 'one size fits all' standard of justice. |

I'm more a fan of the opposite. In my experience, judges only deviate from the suggested punishment when it is in their power to punish the individual further. Never have I felt that further punishment was warranted at all. |

well, DAs have the responsibility of bringing specific charges before the court which allows them certain latitude. i know that judges in australia sometimes take various circumstances into account when sentencing. that's not to say that mistakes arent made of course.
of course, you have a silly process of electing some of these officials which i think is a terrible idea. |

When you beat up "some" guy, do you beat him up because of some inherent characteristic he has which is the only reason to provoke you to beat the out of him? Or are you just a drunk idiot and you beat the out of the guy because of an argument or something he did?
See the difference yet? Hurting someone because of who they are is arguably worse than hurting someone because of their actions. |

My Girlfriend's dad has been in prison for the last 13 years. It was his first offense ever - aiding and abetting in the illegal manufacture of firearms - and now he has a life sentence because the judge's son was killed by an illegal firearm a year prior (not one of his, mind you). Yeah, I'd rather leave sentences up to paper, not people. |

How is it worse though? The result is still the same, so why does motive truly make that much of a difference? |

anecdotal arguments arent particularly strong as im sure you're well aware. there are just as many examples of people being treated too harshly because a judge had no discretion.
and really, manufacturing firearms illegally is a pretty serious offence in my world. |
