Lawyers.

Arguing with Sarah in the hobbies thread got me thinking.

When someone counters an argument from someone else the general assumption seems to be in my experience that the person arguing against them is taking it oh so personally.

This lead me to consider that maybe this is why, at least in the US, people tend to think of Lawyers as being evil?

Lawyers (good, honest Lawyers) do nothing more than represent a parties view point in the most effective way in order to achieve an end through the process of law. In that sense they are literally tools, or a means, for another group to accomplish something. To most people though this is totally beyond them. They see the lawyer as having a personal vendetta against them, or the lawyer is taking the issue personally.

So where does this come from?

My theory is a lack of peoples ability to step back and view their own arguments. If they do this then they can see that they are wrong. To blindly just believe that someone only argues with them for a reason other than the actual issue at hand is much easier. "It must be about me, not the issue" or "It must be about their personal circumstance, not the issue."

Your theories?

1. Lawyers are seen as evil because the stereotype is that they will argue any point of view regardless of whether it is true as long as they see a buck in it. They are seen as unscrupulous.

2. The law is seen as something esoteric, written purposely to be difficult for ordinary people to understand, making it easy for unscrupulous but clever people to rob good but less clever people blind.

3. Also most Americans have no training in real logic or argumentation, so I think there may be an element of intellectual resentment and fear in there as well. ;-)

Law has to be broad but defined, and in doing so that makes it very esoteric and confusing to most. That is why it is hard to understand and requires many years of school to practice it. If we had laws that are simple, people like Slylee would run the country and we'd have all sorts of insanely specific or overly broad laws that contradict each other and are ultimately more unfair to everyone. Thats not a personal blow to you Jamie, its just some of your posts demonstrate a very small understanding of legal egalitarianism. Law by its nature is complex, though once you begin to study it, even by oneself it becomes a lot more accessible and understandable.

Practicing law makes you a servant to the people or the state, in that you have the skills to interpret the law and apply it for or against whatever the issue may be. At least in the US, for criminal trials, a lawyer is a guaranteed right and a hall mark of public servitude.

This is a problem that extends far beyond lawyers... :p

I agree with you dude, my mom is a lawyer. I was just explaining the typical populist resentment against lawyers.

I only have a problem with ty attorneys. Incompetent attorneys who should never have been allowed to take the bar. If within five minutes of speaking to you, I can tell you're a tool, you will never represent me or anyone in my family.

Then again, I'm a cocky . It happens.

The only lawyers you hear about are the Ed Fagans who embrace and cultivate the cliches for PR purposes. You don't hear about the 99% of lawyers who do the daily routine work and never even enter into litigation.

i've worked at law firms my whole adult life pretty much. trust me when i say it's rare to see an "honest" lawyer:stongue:

even the nice ones are full of and overcharge their clients. they dont ing do ANYTHING. and im not talking about ambulance chasers because a high school student could be a PI attorney. i've worked for white collar criminal defense lawyers and corp lit lawyers who were "nice". lol they're all shady and full of like i said.

MAYBE if u go to the DAs office you'll see some hard working lawyers, but that's only because they're fresh out of law school.



also, i'm mainly speaking for lawyers in south florida. obviously i can't say that about all lawyers, everywhere.

So? I also have a far better understanding of law than most laymen does as well because of it. Thats a good thing.

Course most children don't read bar exam essays for fun then questions their parents on them... :wtf:

the paralegals do that work, not lawyers.
