Yea, so a motorbike crashed into me last night

Unbelievable! We were making a legal u-turn, signalling, etc. Everyone stopped to allow for the turn, and this guy passed the other cars, tried to do the "i'm on a bike, so i can drive through and between traffic" thing and drove right into our door! Christ! Thank god he didn't get anyone (esp his chick) hurt. They both walked away without a scratch.

If you say an officer is involved, your insurance company is likely to find out, so you should go anyways. The bike rider would have offered to take care of the damages right away, so if he didn't say so yet, he likely will report it, but writing off a bike is cheaper to an owner than writing off a car generally. You can always call him, but record the call with your mp3 cellphone, handheld pc or pocket recorder. The wort and possible thing that could happen, is not him claiming damages on his bike, but claiming disability, pain, suffering, etc...

I think he's gonna report it, he said he would. Unless he changes his mind for some reason. Is there any way i can find out if he DID report it? And is there a deadline, past chick i KNOW he wouldn't be able to report it? Also, what if my friend was behind the wheel? My license is suspended, so he was driving. From what i heard, he should still be convered under the policy, since he's a licensed driver.

dude u should report thew collision it wasnt ur fault if u did everything the right way, and most likely his insurance will cover it...

i dont think there ia s way to find out if he filed, but my bet is he most likely will... and if so then his insurance company is bound to do some sort of investigation.

First off.....Diabolic is at fault for the accident...from the limited information he has provided us in this story. He is making a U-Turn...wether legal or not....he is still at fault for the accident.

Secondly.....you better hope there were no injuries....because the other person was on a motorcycle his insurance company will have a right to recover payments from your insurance company minus the initial $2000.00.

Third...your rates are going to go through the roof. I would think a 200-300% in your rates will be about right.

you're very lucky no one got seriously injured........

so how bad is the damage to your car?

Motorbikes are dangerous full stop........someone i know died from a motorbike accident, i cant believe these people didnt even wear protective gear........idiots i say.....

Scott's got it right on all fronts here. Without question Diabolic will be considered 100% at fault for the loss. If either party on the motorcycle were injured his insurance company will know about the accident whether he reports it or not (as the insurer for the injured party will be putting them on notice of their intent to recover payments within 90 days). A rate increase is definately in your future.... I don't know about 200-300% but you're under 25, single, male, living with your parents and driving a sports car so you're pretty much ed.

FYI folks.... NEVER make a U turn or left turn unless there are NO vehicles in your path..... EVEN IF SOMEONE SIGNALS YOU TO GO.... WAIT UNTIL THE ROAD IS CLEAR.

You are SO ed. It's not even funny. It's like you broke a mirror shortly before you bought the car, and bad just keeps happening to you. Luckily for us here, we got about 6 more years of entertainment at your expense.

In terms of fault, no. When you're making a U-turn or a left hand turn the Fault Determination Rules (in Ontario the FDR must be used to assign fault for physical damage and Accident Benefits claims) explicitly hold you 100% liable unless the other party involved was committing a criminal code offence. So, for the purposes of the collision and accident benefits claim Diabolic will be 100% at fault.

Now, with regard to the impending (likely) tort (civil law) suit Diabolic will/may face then it may make a difference. If the motorcycle pulled out from behind a stopped vehicle to pass or was passing between vehicles then the driver of the motorcycle may be found contributorally negligent. This is to say the court (judge or jury) could find that the motorcyclist's actions partially caused the injuries to the cyclist and/or his passenger. I say partially because the bulk of negligence will still rest with diabolic for not making sure the way was clear before making his u-turn. Generally speaking, when a vehicle is passing another vehicle outside of their designated lane of travel and they are struck by a vehicle turning left across their path the passing vehicle will be considered 10-15% contributorally negligent.
