Hate Crimes?

I watched this thing on the news yesterday about two lesbians that got beat up at a school while picking their kid up.
right off the bat, i think the fact that this guy beat up two lesbians is horrible but....
Why is it that when someone beats up two lesbians because they hate lesbians its called a hate crime (with stiffer penalties) but when i walk into a bar and beat the out of some guy its only assault?
WTF? when you kick the crap out of someone, you obviously hate them? so why does it make a difference that you hate them because they are a douche, or a lesbian, or a scientologist?
Assault is assault... this whole hate crime designation is just plain stupid imo..... |

by protected you mean minority , right?
i think it should only be called a hate crime if there's some kind of violence/anguish towards the actual person's background.
example:
the dude you cited above...say he beat up two lesbians, but didn'tknow they were lesbians. that's just assault to me.
other hand: the dude KNEW they were lesbians and beat them up simple because of that.
its all about motive/pre-emitveness. |

my point is that why is it worse to hate someone based on their sexual orientation, religion etc. than it is to hate someone just because? I mean is it's all assault in the end? who cares why you did it, the fact of the matter is that you did do it? |

i think the facts that need to be established are:
1. was the ass-kicking motivated by a random event (ohh i dunno... they ran over his favorite squirrel in the school's yard).
or
2. was the ass-kicking motivated because they are lesbians.
then you can discuss whether this is assault, or hate crime. i believe there is a difference. when someone targets another individual because of a specific trait (sexual orientation, relgion, race, creed, disability, etc.) - that's a hate crime. when someone kicks someone's ass because they called his momma fat - that's assault brotha.
edit: and i think the whole point of the difference in classification, and stiffer punishment with the hate crimes, is an attempt to eliminate such events from occuring.
no one's saying it's better or worse, and fighting is certainly a brutal and animalistic way of solving a problem. however it will happen, i think the government wants to do their best to eliminate pre-determined, or biased attacks. |
