Smiley faces are trademarked all around the world
THE smiley face... Im not sure if it ever was. I know they guy who designed it never got a penny for it, or maybe a few dollars... I have the story behind it at home.
You should have noticed Wal-Mart is phasing out their Smiley face after they had issues with it around the world. They never had it trademarked. |

You are correct!
The essential function of a trademark is to exclusively identify the commercial source as a badge of origin.
Though I don't find IP exciting, IMO Intellectual Property applies here because it consists of new ideas, original expressions, distinctive names, and appearance. Trademarks, patents and designs collectively form a subset of intellectual property known as industrial property.
I thought of Patent because of the overall look of the sign for this place. If I recall correctly, Del once handed out T-shirts a few yrs bak with TOTA printed on them. Had TOTA been patented, then an infringement of TA's commercial distribution and use would exist.
If a commercial business can litigate against the cyberworld, then IP has to infer equitability where the situation is reversed i.e. cybersquatters (domain squatters) that registed with the intent to profit from the goodwill of a trademark belonging to someone else.
The courts are hearing IP cases where new commercial businesses are borrowing form e-commerce to propel their business into an instant association, affiliation or recognition.
Perhaps to a Joe the name TOTA may just looks like an Acronym but to some bussinessmen it's called lost future revenues.
Lastly I'll state that this is Del's call, not ours. We are just here to give a general opinion and can express it freely in this forum. I think it's great when subtle humour is posted by regulars. Though we all percieve differently based on what we think we know of the person(s) posting, IMO it really starts to get boring to see mockery, ridicule and antagonistic expressions. It's just so high school for TOTA's to go at each other. Perhaps we should all try to keep it clean in this community because that's the great thing that made us different from Tribe. |

I've given my opinion.
Perhaps in my attempt to multi-task and oversimplify I came across giving negative scenarious, when in fact there was more to my thought process. That does happen happen Lisa.
