Speeding Ticket Advice Needed

Ok, so Friday night, on my way from Toronto back to Waterloo, i got pulled over for speeding. I'll go into the details of the happening, as I believe they are important.

Highway 401, middle lane, doing around 150 km/h, 2:40 AM, Cambridge area, just past Hesspeller exit I notice a cruiser parked on the right hand side, so I slam the brakes.

Cruiser starts following me, and pulls me over, I stop on the right hand shoulder.

So the officer comes to my windows, I get asked for my drivers license (asks if I drank, i say I had one Drink, tells me my sticker is 1 month expired, i showed him i had it in the car just never got around to displaying, he says it's ok to all this), and I'm told i was doing 147 km/h in 100 km/h zone. Cop goes back to his car.

Meanwhile, another cruiser pulls over, next to the other one, and takes off after a few minutes.

The officer comes back to my window, shows me fine for doing 47 km/h, but says he will give me a ticket for 15 km/h over the limit, and that that's not going to give me any points. Tells me i have 2 weeks to act on the ticket, and drive a little slower next time and i will be ok, cause you never know who I ran into and how they will be.

I thank the officer a bunch of times and leave.

Later at home, I look at the ticket, it says I was speeding doing 115km/h in a 100 km/h posted zone. Fine is $52.50. On the cheque provided (option 1: pleading guilty an paying by cheque) it was already written $110.00, in his hand writing.

Now, I am thinking of taking it to court, in the hopes of having the entire ticket erased. I'm not concerned about the fine, but I don't want to have this ticket on my insurance record for the next 3 years.

Given the situation, I am wondering if the cop was going to let me off with just warning, and the 2nd cruiser was what lead him to give me a minor ticket.

Also, the wrong amount on the cheque makes me think if he actually wanted me to take this court (just a supposition)

One thing I am concerned about is the officer showing up in court and saying i was in fact going 47 km/h, and he was just trying to give me a break.

Thoughts? Suggestions? Advice? Let me know!

You got caught doing 147kph on the 401 here in Cambridge and you got off with a 15 over?

And you're thinking of fighting it?

You should probably turn in your licence and have your car crushed

Why? Are cops serious more serious in this area? Any hands on experience you might want to share?

I wouldn't even think twice to just paying it off and never thinking about it again. You got REALLY LUCKY!!!!!!!!!

That is 3km/h away from being 50km/h over and I'm sure you know what that means...

Be glad you had no points deducted. I got hit hard on hwy 6 (80km/h zone - wtf!) and was doing 128km/h on my way from sarah's to U of W to write an exam. OPP pulled me over and gave me the quickest ticket of my life, 2 mins in total, $350 fine, 4 points, 48km/h over.

I was like, holy !!!! I fought it and got it reduced to 29km/h over in court, which is still 3 points. I guess I saved myself 1 point and $120 in fines but I didn't expect to get much considering how much I was going over in the first place.

So ya, that could've been a 4 pointer but you got 0 so take it, pay it, and leave it! :wtf:

wow you are a douche. You were 3 km/h away from losing your license and car, so thank your lucky stars you still got something to drive and man up to your own mistake. Douche.

Anyone who gets that lucky in the vicinity of Framebridge, Snitchener, or Raterloo, should be more than greatful. Pay the ticket dude!

going to court tomorrow for 40 over on gardiner. $301 and 4 points.

will they drop the points if I plea guilty with an explanations and pay the full amount?

You guys are missing the point ... I am grateful. In fact this is the first time I talked to a normal cop, so i was pleasantly surprised ... and the break i got was beyond belief to me. I've had another ticket on my record for 45 km/h over, took it to court and got it reduced to 35 km/h, so by no means I am not grateful.

The whole point im trying to make is this:

The officer doesn't PERSONALLY care if i take it to court or not ... he did his job ... part of his job is to show up in court, for which he gets paid to as well. If i win, since the actual ticket say 15 km/h, i have NO conviction. This has nothing to do with paying the $53.00 fine, or any sentimentalism, or the stars and the universe, or my gratitude to him ... i'd get him flowers if I could. This has simply to do with a conviction going on my record for the next 3 years, AND if someone has some insightful hands on experience (similar situation, court cases, tickets and charges dropped, OR taking it to court and getting charged with other things, etc) i'd greatly appreciate it if you shared it with me.

did you go to a first attendance meeting before hand?

I always go to a first attendance meeting before court because sometimes (depending on the person you get) they will drop it/reduce it and that way you don't even have to bother going to court in the end.

However, if that doesn't work then you schedule a court date and they will most likely drop it to some degree, something you two will work out.

Oh ya, always plea "not guilty!!!!" don't plea guilty with explanation.

A helpful person ... and a friend indeed. That's what i was aiming for. Hats what happened with my previous ticket, and since this is for only 15 km/h I don't think a judge, or a cop will waste their time in court finding me guilty of speeding. ONLY thing i am worried about, and could use an informed advice is, COULD THE OFFICER KEEP AND SHOW HIS EVIDENCE OF ME GOING 147 KM/H IN COURT, EVEN THOUGH ON THE TICKET HE WROTE 115 KM/H.

Would that back fire agains him, hence he wouldnt use that as proof, OR can a cop legally use his discretion and give me a ticket for 15 km/h though i was 47 km/h over? Without breaking the law himself? Anyone know?
