How is possessing a picture criminal though? With that logic any picture of any crime should be illegal because the victim didn't sign away their rights for distribution. |

okay. let me say it again. child pornography does not fall into the realm of a consensual crime because children do not have the ability to give consent. they have not yet reached the age of consent.
if you have a picture of this child or a video of this child engaged in pornographic activities, it is illegal to have that picture or video because the child could not and did not consent to its distribution.
a picture of a crime scene is not the same thing. if you took a picture of a burning building and the fire was started by arson, that would not be illegal. you are not exploiting the owners of the house by having a picture of it burning. you are most definitely exploiting a child by owning images or video of them being molested. your comparison makes no sense and it's almost like you are arguing for child pornography possession as if there isn't anything wrong with it and it's disgusting. |

A picture of a rape in progress and the victim is over 18 is perfectly legal. Is that not a double standard?
Also I choose this argument often because its one that is very emotional for most people. Most can not take a cold calculated logical look at it. Its more of a test than anything. It tests if you can look at the gray areas and not just fall back to a simple black and white interpretation of it. |

rape is a crime where you have a non-consenting adult. were you to distribute photos or pictures of her rape, it would be the same thing i said for child porn. she did not give her consent, so to possess images or footage of said rape would be illegal. she has every legal right to sue you for distribution or possession of that image/footage. |

Its not illegal though. :stongue:
There is nothing preventing me from googling right now pictures of a person being raped, real rape, and looking at them, downloading them, or posting them on TA. It is perfectly legal in terms of criminal law.
The only way the victim would be able to go after someone is if they took the person who had them to civil court for violating what would essentially be their copyright. Copyright is a civil matter in the United States. |
