All that is taking place is from a GOVERNMENT point of view

In a democracy, the government is supposed to represent the views of the people!

Nonsense. Look at the Charter itself:

52. (1) The Constitution of Canada is the supreme law of Canada, and any law that is inconsistent with the provisions of the Constitution is, to the extent of the inconsistency, of no force or effect.

i.e. struck down

(3) Amendments to the Constitution of Canada shall be made only in accordance with the authority contained in the Constitution of Canada.

i.e. a court cannot amend the constitution to get rid of heteroexual marraige, only Parliament can through the procedures laid out therein. No reading-in / legislating from the bench!

You continue to be very misleading here.

First off, the constitution is NOT being amended. Section 15 is being interpreted to include same sex couples... as I said before (and has been upheld in many other cases on a variety of topics), the list in section 15 is NOT exhaustive and is not limited. Furthermore, heterosexual marriage also does not appear in the constitution.

Secondly, no one is "getting rid of heterosexual marriage". It was there last decade, it was there yesterday and it'll be there tomorrow.

And it is also supposed to protect the interests of those that are not in the majority as well.

That's a backdoor amendment!

The proper branch of government to enact such a change is Parliament.

It's being attacked in the law. They didn't amend the laws in a moderate fashion as suggested by Jem_hader... they went for the throat!

That should not ever take PRECEDENCE over the democratic majority, or their constitutional rights. When minority rights are given a higher priority than democracy and constitutional rights, it's communism.

Uh... last time I checked, it IS Parliament that is now in the process passing the legislation to enact this change.

Similiarily it was the Ontario Legislature that passed THIS bill in question to adopt the changes.

Remember... either of these legislatures could have stepped up and used the notwithstanding clause if they felt either of the courts were so far out to left field. Neither has.

While minority rights must be protected, so too must the rights of the majority be protected! The democratic process balances the two out.

Bill 171 is an all-out attack against the majority.
