This is a funny situation. On the one hand, they did facilitate sharing copyright material. On the other hand, in most countries, you cannot convict somebody for a crime, if somebody else is using your system for a crime. The same was said for phone companies, and drug dealers. Would you hold the phone company at fault because drug dealers were using their lines to facilitate sales?
The torrent freak article is right, this is going to open a whole new can of worms and just slow broadband penetration. It is already happening here. Instead of breaking down barriers, and making systems more open, we are moving backwards. |
or suing the city of toronto if there was a shooting on yonge street.
it's definitely a step backwards in the internet society. |

Whether they know what's being shared or not isn't the issue. Any reasonable and prudent person would know that copyrighted material could be shared on a website such as this. They took no measures to prevent or stop this from happening. |
ok, and how do you supposed they do this? the material on pirate bay is coded by the pirates so no one really knows what it is exactly.
basically now since you can use google to search for copyrighted material than google should be sued for facilitating piracy. but since google is huge of course no one will go after them. |

Sigh ....
First it was the mecca of all meccas, SuperNova and now it's PB.
This is why I suggest anyone to not post a "source" on a public forum. More ppl know of it, the faster it hits the fan ... just like PB today |

What you have to remember is they were convicted of providing assistance in making copyrighted material available. The website itself is there for people to share information for download. It is foreseeable that copyrighted material would be shared through this website. I am pretty sure all of them had knowledge that copyrighted material was being shared using their website and they should have taken reasonable measures to prevent this from happening.
edit: google is not set up to assist people in the same manner as this site....there is a big difference between the two. |

why isn't google seen as giving assistance to share material? if i was to look for material that is how i would find it.
i really don't think that you understand the situation at all.
how about suing the ISP that the people downloading copyrighted material use? they give assistance to piracy. how about suing Dell for selling computers since they definitely assist in the piracy.
don't you see the slippery slop that this will lead down?
there should have been a totally different way that this was dealt with. |

these guys themselves don't actually have any servers or anything offering free stuff to download. they are not the ones that record or steal the material. they aren't even the ones that download it. they just run a site where people happen to share files and it's not like they control what files are shared. they don't even know what files are being shared technically. |
do you know how much money they make off of advertising?;)
hosting things or not, they are making a profit out of piracy, and that is wrong no matter what you say. |

isp's are starting to give consequences.
lets say you want to download an nbc show. Nbc puts a torrent up of it, and logs who downloads it and sends it to the isp's.;)
right now it is only letters, but soon it will be worse...ie: termination of services. |

We need to get rid of most IP laws anyways. This is just old money trying to protect them selves, so they don't have to evolve and adapt.

No, and nobody does. They spend an assload of money on colo-locations servers, including bandwidth. They have stated that they barely break even, and I believe them, because of what colo costs are.
If you have the income statement, please inform us, considering even the prosecution did not have accurate figures. |
