if the check was made out so both of you need to sign it then you should be entitled to some of the money.

From my knowledge of law, there is no binding agreement with either party regarding the cash. Saying that you signed the papers and left and were "done with it all" would imply that further money is no longer your domain. It being money coming from an earlier payment, the payer would be the one entitled to the cash, and the primary resident/renter.

The only way I see you "deserving" the money is for damages suffered from premature termination of the living contract, but youd have to prove in a small claims court that said contract existed and furthermore that the contract was terminated unconsentingly and due to this unconsented to termination, 100 dollars of damage was incurred.

let me reiterate, she's not an attorney, and she doesn't want to play one. embarrassing him will get you nowhere. you want your $100 here, that's the goal, so you need to avoid miscues.

that's the beauty of e-mail - dealing with an issue over that medium can almost be like not dealing with the issue. i say you e-mail him and pour out your bleeding heart for all the bull he put you through, and guilt him into giving you the $100 because he "owes it to you".

however, stick with getting $100 for signing it, because he won't split the cash with you once it's in his hand.

there's no legal issue here...it's in both your names...meaning you're equally entitled to the money whether he paid the back taxes or not...


just consider it tax :p

Technically what youd be doing is extortion if you demanded money in return for the signature. Especially when you, as I see it, have no legal right to the money.

What is the nature of the check, and why is the money coming back? I wasnt clear on that
