Technically what youd be doing is extortion if you demanded money in return for the signature. Especially when you, as I see it, have no legal right to the money.

What is the nature of the check, and why is the money coming back? I wasnt clear on that

in his words...

I wanted to reach you regarding Cornerstone Crossing unit ###. I overpaid my taxes in escrow last year. Wells Fargo issued me a return for $200.00 however I cannot cash it without your signature.

Yeah...you have no rights to the money :\ if you want to claim reparations for homelessness and pain and suffering and undue duress then I would use that route, but holding a guy up for ransom for money that is technically his is kind of dick :S

if it was his taxes that were overpaid...then why would it be addressed to both of them unless he claimed her as a spouse at the time? in that case...why would it be extortion.
Orbax
Escrow payments in regard to housing payments would be issued to the tenants at the time. So the extortion is saying "If you want your money you have to give me some"

tell him you'll sign it if he hands you $100 at the time of the signing.

nobody can make you endorse the check.

agreed.

or if you don't care about $100...then ignore him...if it's all his money, then this is his problem to figure out ;)
Floorfiller
i still don't know if i'd call it extortion haha....that's a pretty serious term.

he did utilize her credit score for the acceptance of the loan. they made this contract as a joint...the fact that the money was in reality coming from an individual doesn't seem to make a difference. they came to a personal agreement at the time to pay the escrow in that fashion...

i say you're still entitled myra.

That true, but it isnt the decent thing to do. Its always nice to walk away from a situation knowing you handled it with grace. This guy sounds like he probably has a bad life, why make it worse?

the use of co-signators is a negative entitlement. That means they only get action on failure of primary signator. It doesnt entitle them to the money from the loan.
