You should really read the appropriate statutes.
As for the tort side of things... you'd need to prove damages for a tort to have ocurred. I'm supremely confident that you haven't, so I'm not too worried. |

Indeed. This aspect would likely then qualify this as newsworthy; subsequently, reproduction and distribution would be allowed under the CDP Act for those purposes.
You need to be careful what you publish.

defamation is a tort they are not two separarate things.
republishing of, or re posting in this case, defamatory materials are protective of the poster in accordance with the supreme court of Canada decision in hill v. church of Scientology of toronto.
Since none of us altered your text in anyway (it was a direct quote from your website) you have zero recourse as no tort has occurred AND precedent for this type of tort is well established in both the Canadian common law system, and in decisions from the British house of lords which Canada will still adopt precedent from time to time, a good example of this would be the hedley byrne case which established duty of care for professionals to clients and third partys who rely on their professional recommendations (later annulled by the advent of the limited liability clause or exemption clause) |

i think what wacko asho is failing to comprehend here is that the ONLY recourse for libel, defamation and copyright infringement in canada is DAMAGES.
DAMAGES are assessed to be the monetary damages incurred by the plaintiff. these damages must have been "reasonably foreseeable" by a reasonable person at the time the tort was alleged. I am very confident that no reasonable person would reasonably foresee you making ANY profit off of your rambling incoherent rantings, hence no damages could have been reasonably foreseen by the tortfeasor (person committing the tort, or concurrant tortfeasors in the case of multiple parties)
Legal costs are not considered direct damages and therefore can not be used to establish that a tort has occurred. |
