Does this make any sense :

A guy from mexico with a truck full of bootleg movies and music cds tries to cross the border into the USA . What happens ? I'm not sure if he'll get arrested of just not allowed to cross the border with the illegal goods but I know hes not getting across the border .

So he drives home to his house in Mexico , uploads it all to the internet and "crosses the border" by distributing it to people in USA .


Does that make any sense ??

Theres laws at the physical border of the USA but they don't apply on the internet .

Mmmm...I think the government needs to step in because its plainly their job to keep illegal goods from crossing the border , whether that be a physical border or other means crooks try to use .

Its that simple .

There are only cons so far. There is a rather large step from making people criminals to getting the right people the right recognition. Your website makes you a criminal just like everyone else. And they will be prompt to shut down anything that has a small percentage of being illlegal and take their time to reverse bad desicions.

So given that you are hosting unauthorized remixes of copyrighted materiall, your website will be viewed as any other website hosting similar copyright infringing magerial.

wrong, i'll get a notice to remove IF the rightsholder finds it disturbing and files a case, then Soundcloud will remove it and my hotlink will no longer work. If this happens too often with many users, it's more favourable for SC to develop a mechanism that prevents copyrighted material to be uploaded

Nope, you and soundcloud are in the wrong. They are not going to review these personally. You will be sent a statement attesting to your alledged copyright infringement until you can prove otherwise. And I do t thonk your website will be on the fast track to being re evaluated. This new law does nothing constructive. The question smart people ask is how do we get the copyright holders paid. Gthe idiots that draft ghese bills are concdrned abourt deterence aand punisment which has never worked. You obviously did not watch the csapn discussion. The prevailong attitude by the mps was, well I dont know anything. About the internet but this seems like a good idea.

BU L4C that's how legislation works, example function, "unfair" to some, rapid inventive conformation by others. suddenly they all can comply.

It's not that YouTube, Facebook and Twitter and all other utter social boredom sites will suddenly cease to exist. And if they do, not a problem either.

this is scorched earth policy. Want to know how silly it already is ? Lets say you have a dog named TinTin. Any file with the name TinTin in it will pre-emptively be removed by any file hoster.Go ahead and try. Create a video called my dog tintin.avi. It will be removed in less than 24 hours.

Now imagine this new power. They are not going to hire people to review all the complaints. They will implement heavy handed algorithms that will send a list of alleged offenders even if they are not guilty of any crime. That is easy. Now imagine all the people that will complain. Unfortunately , this can't be handled by a computer so the process will take weeks , months basically ruining alot of for alot of legitimate users at whose benefit ? There is none. Nobody will benefit. They have still to prove a link between piracy and sales. Some studies show that viral videos with copyrighted material actual boost sales. A clip of family guy gets someone interested in the show so they start watching. Restricting access does not make people consumers. They are missing step 2.

This is what they are talking about when they mention the reversal of the innocent until proven guilty concept. And because bigger companies will not risk downtime, they will be overly heavy handed with their algorithms. A policy of overkill forced by legislation that is overkill.

The problem is that it does not address the real problem and that is how to compensate those whose copyrights are being abused. And that is why it has no pros. Only cons. That isn't to say piracy isn't an issue. But this is far from a solution. It will only increase operating costs adding nothing of value.

This is how I got interested about Family Guy.

I am confused about one thing... let's say that Pipa, Sopa and other crap passes, then Ivan from mother Russia that downloads the latest Justin Gayber album from ливни предела Бориса.org, will go to gulag in Siberia, go to prison in US to have his ass shredded or nobody will do anything to him?

As for piracy, I see it as a 2 edged sword. Let's take the movies as an example. You leave in to a country where u barely manage to earn 3000/4000$ in a year. From this money u have to pay bills, manage your health and eat. You just can't buy every movie out there and can't rely on the trailers that the movie is good. Here piracy helps you to "try before you buy".
I don't know how things work in the US, or more wealthy countries, but here in Romania even TV Networks use warez software and as I understood from a friend from a neighbor country, the piracy is getting more hard core eastern you go in to the Europe. I think that on russian torrents you find stuff that doesn't came out yet oO.
