But we've already established that the creation of child porn is highly illegal and immoral, so it doesn't have any right to be "said", unless any action can be justified by bleating about freedom of speech. For instance, if I stabbed Nou in the face with a broken bottle, I could argue that my action was a form of expression and so I should not be punished for that expression due to freedom of speech.
You cannot play the free speech card without believing that child abuse is a valid form of expression. And if an expression has lost the right to be said, then why should it retain any right to be heard? |

But many countries already do, and I see no problem with that. I do not think your right to watch kiddie diddlers ply their trade outweighs children's or former children's right not to be seen being abused.
So for me it is a matter of privacy of the abused children, not a pragmatic issue. Allowing people to view kiddie porn may or may not "perpetuate" the making of it, but for me that is a side debate. The primary one, for me, is why people think the right to view kiddie porn is more important than the privacy rights of the kids involved. |

The "speech" I am referring to is the dissemination of the porn, not the making of it. My paragraph was about the related point of whether owning or viewing a form of speech is a necessary ingredient of free speech rights, even though I do not personally think the right to make or spread kiddie porn should be considered part of those rights. |

I'd argue the same again: dissemination is only repetition of an original statement. If the original statement has no rights, neither does any repetition of it. |

| Yes, I think that's true. Like I said, I was making the general point that freedom of speech necessarily includes freedom of viewing, not that the two rights should apply to kiddie porn specifically. |

i can remember that i saw a vid of a 17 yo boy murdering another boy over an ipod (without his consent). that vid was all over the news. did i conduct, just as millions of other viewers, a criminal act by watching that news item?
i've seen that vid of 2 russian guys molesting and murdering a random guy (without his consent) with screwdriver and a hammer, right beside a highway. did i commit a crime by watching that?
so if i've seen a vid of a guy in his 40s conduction a sexual act on a 7 yo (without her consent), would i commit a crime?
please answer me those 3 questions...
edit:and oh yes, i forgot. if the age of consent in Holland is 16, IT IS 16! sex with a 12 year old is a crime, even if the parents agree. wtf.. |
