Actually, choke holds have been banned in NY for over 20 years now.
I have no ing idea how this guy didn't get indicted. I was speaking to a lawyer I know and they said indictments are hardly ever refused when there's real evidence (i.e. video, DNA or fingerprints, not just circumstantial merit etc). The indictment just gives the green light for a full trial for both sides to present the evidence.
I just cannot see, even if he had committed a crime, how the officer did not unlawfully cause his death by using a banned choke hold that let to the suspect dying.
As for the guy that filmed it - he's saying he's being framed; That the officers involved are just punishing him for filming it. You never know what the truth is but you'd have to be really, really dumb to be standing there filming the police (and shouting at them while) with an illegal gun concealed on you.
The crazy thing is, a grand jury saw fit that just witness testimony (from a police officer) was enough to indict this guy of an alleged crime, yet a clear video tape of a crime being committed (using a banned choke hold) was not. |
