i told you guys my persian radar is fine tuned...
I realize that they don't release the names of the "victims" in such cases but are the names potentially released IF the allegations are unfounded or these guys are found not guilty? |

they shouldnt release any names of any suspects unless they are found guilty. With the exception that releasing the names may aide in capturing the suspects. Otherwise i think innocent until proven guilty should also resonate in the media. |

If these guys are found not guilty, I'm sure there will be less than a small blurb in the back of the Toronto Sun. It's not sensational enough to report on people being wrongly accused and vindicated at a later date. |

The freedom of press act is not on their side for this one. The only way that their names would ever be kept out of the media is through judge imposed gag order, or if they were minors. While this may seem unfair, the freedom of press act's positives outweigh the negatives. They do seem to be using "alleged", so the media has fulfilled their end of the bargain and nothing can be considered as libel. |

I actually guessed that on the first link, the one that had their pics and no names. but i had a suspension they were all Persian.

The news said they did away with the charge of rape a while ago.. and changed it to 3 levels of sexual assault and that these guys were charged with at the highest level.
The paper stated gang sexual assault. |

i know its the law... but i disagree with it. I am a complete libertarian and fully support freedom of the press. But i think the rights of a potentially innocent suspect trump the rights of the press in this case (ideally). If this person is found guilty, only then should his/her reputation be destroyed in the court of public opinion. As it is now, you are guilty no matter what and the stigma is hard to erase if you are innocent. |
