It was an out of court settlement... so the 22 million was to get them to drop the suit... the suit was dropped... they've got nothing to sue over. |

It would never succeed.... first they would have to prove that the allegations were false (it's presumable that the accuser would recant his acertation that his allegations were false if he were sued), then the estate would need to prove that this particular allegation directly resulted in financial loss to Michael Jackson (which would be next to impossible given the incredible amount of factors that come into play influencing radio play time, album sales, tour receipts, etc). They would never meet the test... defamation suits very rarely do. |

If a defamation did occure then presumably they could as the liability owing to Michael resulting from said defamation would pass to the estate just as any other asset. I mean... defamation is a pecuniary loss so it should be transferable to the estate. |

Unfortunately I don't think so b/c a dead person cannot be defamed. No wonder the stupid prick came forward now. However, since the defamation was done during Jackson's life, I'm sure the family they'll try to find a loophole around it though. |

I'm guessing the opposite... if there was a defamation and it were caually linked to a loss (note: I don't believe this could be proven) then the tort occured during the defamed persons life resulting in a pecuniary loss which would be tranferable to the estate... because if not for the tort the deceased would not have suffered the damages; subsequently, the estate would have been larger. |
