You're misreading what I'm saying. I'm actually saying exactly what you did. In other words, if I make a defamatory statement about Michael Jackson now, the estate, nor the person (since he's deceased) can sue because he's dead. But since the defamation was made during Jackson's life in this case I'm saying there would be a chance (whether small or not) that the estate could sue. |

Sorry... I thought when you responded to Scott saying the estate probably could not because a dead person cannot be defamed I though you were speaking in specific reference to this instance not in general. |

No worries. I re-read what I wrote and realized I wasn't very clear.
In reference to perjury though. Wouldn't it be the state that sues for perjury and not Jackson? |

Yes... perjury is a crime, not a tort, so the state would have to press charges. |
