yeah, but then again, the tape shows you resisting the arrest

But if there was no original reason for arrest, then it doesn't matter.

That is incorrect.

http://www.constitution.org/uslaw/defunlaw.htm

"Citizens may resist unlawful arrest to the point of taking an arresting officer's life if necessary."

Remember that tape a week or so ago where an officer threatened to arrest someone for no reason? If that officer had actually acted on that, the above would apply.

(I'm not saying it applies to the tasering incident though)

distant, thank you for bringing this to my attention... and RESPECTFULLY nonetheless. (and not saying something like "STFU Noob")

This is really interesting! Then again, you'd have to know beyond a shadow of a doubt, that you are completely innocent. It's shakey ground.

Do you know of any recent examples of this happening?

Not to mention the fact that while you can resist arrest, you cannot do anything else I'm sure. Even if you were innocent, if you laid a finger on the officer you were resisting, technically thats assaulting an officer, and then you're ed.

If it's unlawful arrest, the officer is the one doing the assaulting.

While you're right, i've never heard of a single case where this actually came to play out :/
I would say that 99% of the time, its going to be better to not resist and just fight it, especially if there's a chance you could have done something wrong without realizing it.

i don't see where he grabbed the mike during someone elses question. it goes straight from kerry talking to that dude thanking kerry for his time. could you show me where this happens?

also, he asks for 2 minutes, had a teacher said, ok the limit is 3, i dont beleive anything would have happened.

“As much as I concur that this was excessive force, let me remind you what led to this:

Andrew spoke up after the Dean of International Affairs had stated final question. The final question was being asked about Israel, and then Andrew got on the mic on the other side of the room (noting he was next on the mic), and then proceeded to tell Kerry that its not fair not to be able to ask more questions after listening to him for an hour."

A fellow student in line to ask questions:

However, while Senator Kerry was responding to a student’s question, all of a sudden Meyer rushed to the microphone with cops in pursuit. At that point no one knew what was going on. Could he have a gun, a bomb? Immediately, Meyer began yelling into the microphone that he had been waiting in line forever and that Senator Kerry should “spend time to answer everyone’s questions!”

God, it's not like the guy was asking anything truly provocative or sensational. He was just being an annoying loudmouth. I think the reaction of the others in the audience shows how most people felt about what he was saying/doing. He was being a ing nuisance, nothing more.

I bet that guy believed everything in Zeitgeist, too. LoL. ing douche.

quote from that article:
After Meyer repeatedly and loudly refused to walk away, two officers took him by the arms. Kerry can be heard saying, "That's all right, let me answer his question."

interesting...

another interesting quote from that article:

"An officer, however, said in the police report that Meyer's "demeanor completely changed once the cameras were not in sight" and that he was "laughing" and "lighthearted" on the way to jail."

yeah he obviously wanted to start controversy...doesnt mean police had to indulge him.
