Irrelevant, a defence is not a prohibition. You are quoting defences not prohibitions of sale.

I already did. The basis of appearance is belief of someone being of legal age. At one point people weren't ID'd for doing stuff, it is a fairly recent measure that has become increasingly strict. The whole you need to be registered to be a citizen phenomenon. I didn't have a single piece of ID when this stuff happened. There was no doubt of my age expressed. The process used was purely processual there was no issue of law, there was no impression of breach of sales laws in place, which only required a belief of the age to be 19 or older, the legal age of purchase. Persons had the discretion to sale. But if they sold to someone known to be a minor or believed to be a minor they would be accountable to fining. If a minor indicated their age as 23 but were really 18, they would have committed fraud. If the case were to go to court as of 2004 if the person was a fully mature person with a beard and wrinkles, chances are they would not be fined.
There was absolutely 0 chance of myself appearing as a minor. I highly doubt a cop would have used such extreme force if they believed me to be a minor both the cop and the clerk did not question my age for legal purchase.

You clearly don't understand law DEFENCE IS NOT PROHIBITION.. a defence is a means of challenging a charge - it is not the sole ability to dispute a charge. Rationality isn't even required to be on the books. There are legal precedents in non absolute liability, which include mens rhea. If someone sold to someone believed to be a minor, yes it would be a crime, but if they sold to someone they believed to be an adult it would not. The question the would be - what grounds do they have for that belief, and did they intentionally contravene the law.
Fact is - if it ins't prohibited, it isn't illegal. If something is prohibited but there is a defence it means that in the case that something occurs within the grounds of the defence it ain't iliegal.
In these instances selling cigarettes to minors was illegal, selling them to adults wasn't. See the difference.
In my instance with no one questioning my appearance as adult that is 19 years of age or older - I was fully lawful.
There is something called discretion - it changed from appearing 19 or older to appearing 25 or over.

Mr. Ashley, you've done nothing but answer with irrelevant conjecture to facts which I have more than substantiated through reasoned analysis and citation straight from YOUR government's website. It is certainly not that any matter is beyond my understanding (no doubt a projection of your own inability to understand - albeit subconscious, as good an admission I am likely to obtain given your strenuous obduracy). As I said, earlier, point me to an authoritative source which you believe makes your claim relevant or my points stand. |

Lay off the drugs.
It was tracy I linked via facebook, I'm not exactly there friends, they framed me up in court which has caused me a lot of ongoing problems and led to a sequence of events that ruined the foundation of my life wasted my youth, years of my life.
And still fuels s like moral hazard and others here to accuse me of things I didn't do.
In time it will be rectified.
I did contact tracy but it is doubtful she will put herself at risk for myself by telling the truth.
Even if the situation dies with them if I outlive them, someday I will die and if life is anything more than a show I will have the opportunity to rectify. I've waited 6 years, I'll continue waiting. Someday I will be exonerated. While it was only a summary charge, it does not erase what has occurred to me due to it, or how it hinders me in my potential desired occupation or travel. It had a severe impact on my life. It is not a non consequential event. For those who have ever been falsely accused of something you may know what I'm talking about. If you've never been framed up for a crime by people lying in open court then frankly you just don't get the situation. |
