Apparent age

(5) In a prosecution under subsection (1) or (2), the court may determine, from the person’s appearance and from other relevant circumstances, whether a person who received tobacco appears to be less than 19 years old. 1994, c. 10, s. 3 (5).

Irrelevant.

no that was the point. You were stating that the sale put the seller at risk, but in this instance there was no risk because there was no reasonable belief held and rightly so that the sale resulted in purchase by under legal age.

May, being the keyword, does not imply will, and being that the law is outdated by the Tobacco Act of 1997, your citation is ing irrelevant.

Do you have any clue how court process works?

Your honour does this person look under age to you?

No.

Case closed.

Then it was

Your honour does this person look over 25 to you?

Yes.

Case closed.

Dude that section of the act stood until july 12th 2005 as is writrten there. So you have no clue what you are talking about, so why don't you just shut your mouth and stop posting disinformation.

Prove it.

Provide a case where this happened. Because I know of 2 establishments in Streetsville that were fined in 2000 and 2001, respectively, who lost their court cases because they attempted to defend themselves using that exact argument. The people that were sold the smokes looked to be in their early 20s, but were only 17. The fact that they sold cigarettes to a minor took precendence over the minor´s appearance.

Did the judge state them as appearing under 19?

Let me know the case name or reference number

LOL, I never bothered to ask them, and the stores have changed owners since. But since you seem so adept at practicing case law, I´m sure you can find one or two instances where your version of the law took precendence over reality.

Good luck.

By virtue of everything you've posted in this thread, you've already lost the case. Internet posting is admissible and, presuming you're going to present as a witness, opposing counsel has more than enough leads and ammunition, in this thread alone, to utterly destroy you, on the stand.

You don't stand a chance, unless you can get this thread deleted.

He´s already lost the case and had his request for appeal denied. And they didn´t need pages of internet babbling to soundly defeat him in court (lol and he represented himself, can you imagine it?).
