You had no proof! You COULD have been a minor. Therefore, they didn´t have to sell you cigarettes. Doing so could have resulted in HUGE fines, because regardless of your actual age, without proof, that was a risk that they would have taken by selling you cigarettes. Cops bust convenience stores ALL THE TIME (and they´ve been doing it since age-of-majority laws were put in place) by sending minors who look like they´re in their 20´s into stores, and having them claim they have no ID when asked for it. How many of those stores do you think avoided the fine by claiming "They looked older than 19"? NONE, it´s not an acceptable defense, and it never has been.

Give me an example where the person believed the person to be of age. The courts agreed that they appeared to be of age from pre 2004 in ontario, but still fined.

Also since I wasn't a minor there was no possibility of a fine.

I totally understand you saying while they could get in trouble if a minor did the same thing so they need to discriminate against everyone. Personally I disagree. Society should not be punished and deprived of their rights due to those who abuse the system by criminality. I have a right to my liberty. Reason is all that is required to defend society against error. Eg. if someone looks too young to buy cigarettes card them, if they look old enough sell them.
Although I don't think it really matters. People are sheep at all ages, more so I think as they age, there tastes just become more ingrained. The main point is, I was of age. There was no doubt of age.
I was sold to by the same people previously.

Actually you destroy your own arugment here. The only way you can proove that is to say - someone did the courts agreed they looked of legal age, then fined them. What you did was say it hasn't occurred, thus we can't determine from those grounds if it was a defence. It would be.

The apperance basis is stated in other laws in Canada such as the Nunuvut tobacco law I stated, it is mirrored around canada that the person must appear to be of legal age. The person selling must believe them to be of legal age - if ID is offer it is evidence of such and in which case the sale must occur. This however would provide for instances where the person was believed to be a minor - but had ID...
not instances where the person was believed to be of age and didn't.

Two totally different things. Fact is you only needed to have the seller beleive you to be of age. It had since changed to atleast 25.
I've said it tons of time. Get the hint.

Fact is only lawful outcome would be 1. sell 2. call the police and charge me with fraud.

The whole refusal of sale is BS.. why the would they ignore ing fraud. If I was a minor they should have called the police - as a civic duty. They damn well believed me to be of age but it was processual - but she didn't follow the policy fully. She failed the policy by not obtaining the manager.

If they honestly look of age - they likely are of quasi majority (16+ in ontario legal age to smoke or was)
You have very few 15 year olds looking 19. And definitely next to none under the age of 12/13 (difference between age of culpability in ontario) - youth offenders. If the age is in doubt call the police in to verify the age if they don't have the ID. Either a crime occurred or they should be sold the pack. If the clerk honestly thinks a law is being broken it is their responsibility to report it.

If they can't be certain call the police in.
